Governor Kasich signs Ohio's Restaurant & Car Carry Rules Fix & Restoration of Rights bills into law

Thursday, June 30, was the signing of Senate Bill 17 (Ohio's Restaurant & Car Carry Rules Fix law) and House Bill 54 (Restoration of Rights), by Republican Governor John Kasich.

"SB17 is critical to Ohio concealed carry license holders, and HB54 is critical to those who have had their Second Amendment rights restored in an Ohio court," observed Buckeye Firearms Association Chairman Jim Irvine. "Ironically, in spite of all the media attention, neither will have any noticeable effect for most of the general public."

"42 of the 48 states that previously allowed concealed carry already permitted license holders to carry in restaurants that serve alcohol," observed Buckeye Firearms Association Legislative Chair Ken Hanson. "Ohio now joins that strong majority.

"Ohio law also allows CHL's to carry into a bar, in that there is no distinction between bars and restaurants in Ohio. While this section is by necessity more liberal than many states, Ohio is more strict than most in placing a strict prohibition on consumption by the license holder, something most states do not do."

Ohio is currently the only state that places onerous restrictions on how a license holder may carry their handguns in automobiles. Most of those restrictions will be repealed when SB17 becomes effective.
Senate Bill 17, sponsored by state Senator Tim Schaffer (R-31), eliminates the current confusing standards of carrying a firearm in a motor vehicle.  In addition, this bill also allows permit holders to carry a firearm for self-defense in a restaurant that serves alcohol, provided the individual is not consuming alcohol, thus eliminating another “victim zone” in Ohio.

House Bill 54, sponsored by state Representatives Ron Maag (R-35) and Jarrod Martin (R-70), would bring Ohio in compliance with federal law to provide for the restoration of firearm rights for certain individuals.

Ohio concealed handgun license-holder defends own life

Ohio concealed handgun license-holder defends own life when attacked by two men at gas station.

Submitted by cbaus on Thu, 06/23/2011 - 07:00. Guns in the News
Dayton Police say a man who was being robbed at a local gas station turned the table on his two attackers, shooting one of them.

According to WRGT, Dayton's Fox affiliate, the attack happened late Friday, June 17 at the Sunoco station.

Police said the robbery victim, a concealed handgun license-holder, was being beaten by two men when he drew his gun and fired. The injured robber, Brandon Turner, was shot in the stomach with two .45 caliber rounds. He was originally listed in critical condition, but has been stabilized and is coopoerating with police.

Police say he admits that he and his accomplice, Billy Blackburn Jr., had no real reason for the assault, other than being "hopped up on drugs." Turner reportedly had both crack cocaine and alcohol in his system.

Police say the shooting was clearly self-defense, and that the CHL-holder will not face charges.

The entire incident was caught on store's surveillance video system.

OH General Assembly passes SB17 (Restaurant & Car Carry Rules Fix) and HB54 (Restoration of Rights); Kasich will sign!

The Ohio General Assembly has passed Senate Bill 17, sponsored by Senator Tim Schaffer (R), which will allow citizens who hold a valid concealed handgun license (CHL) to carry a firearm in restaurants. To do so, license holders may not consume any alcohol and must not be under the influence of alcohol or drugs. According to OpenCarry.org, 42 states (including every state that borders Ohio) allow non-drinking license holders to carry firearms in restaurants.
The bill also reduces burdensome restrictions regarding how a license holder must transport a firearm in a car. Currently, Ohio is the only state to place such complex limitations on license holders. The bill also provides a way for people who were convicted of improperly transporting a firearm under the current law to receive relief if they would have been in compliance under the law as amended in SB17.
